Court Ethics

  1. PREPARATION BEFORE ATTENDING COURT
  1. Verify the Date, Time, and Location: Ensure all hearing details are accurate by referring to the subpoena.
  2. Prepare Complete Documents: If specific documents are required, ensure they are complete and brought with you on the day of the hearing.
  3. Plan Your Journey: Arrive at the court premises before 9:00 AM or at the time designated for your case.
  4. Observe the Dress Code: Wear neat, modest, appropriate, and non-revealing attire.

  1. Identity Documents for Malaysian Citizens: Please bring your National Identity Card (MyKad) or Birth Certificate.
  2. Identity Documents for Foreign Nationals: You are required to present an International Passport or other relevant identification documents.
  3. Additional Documents Based on Role:
    • Government Personnel: Departmental Authority Card and related documents
    • Company Owners: Company Registration Certificate and related supporting documents
    • Company Representatives: Letter of Confirmation or Authorization for Company Representative
    • Property Owners: Title deed (Grant) and property-related documents
  4. If Unable to Attend Court: Ensure your medical certificate clearly states your physical inability to attend court proceedings.
  1. ETIQUETTE FOR ATTENDING OPEN COURT SESSIONS
  1. Punctuality: Be present in the courtroom before 9:00 AM or at the time stipulated by the court.
  2. Respect for the Judge / Magistrate: Stand and bow respectfully when the Judge or Magistrate enters or exits the courtroom.
  3. Full Attention: Give your complete and undivided attention to the ongoing proceedings.
  4. Calling of Names: Step forward immediately when your name is called by the court interpreter.
  5. Prohibition of Noise: Making any noise while the court is in session is strictly prohibited.
  6. Entering and Exiting the Courtroom: Bow respectfully when entering or exiting a courtroom that is actively in session.
  7. Children: Children are not permitted inside the courtroom unless explicitly directed by the court.
  8. Prohibition of Weapons: Weapons of any kind are strictly prohibited on court premises.
  9. Prohibition of Recording: Any form of recording, whether audio or visual, is strictly forbidden.
  10. Electronic Devices: Mobile phones and all other electronic devices capable of emitting sound must be switched off.

A witness is an individual whose role is to provide factual testimony related to a specific case. When a person is served with a court subpoena, it is an absolute legal duty to attend and testify. Failure to do so may result in the issuance of a Warrant of Arrest.

The primary purpose of a witness's presence in court is to present evidence, either orally or through documentation, to enable the court to render a fair decision based on the provided information.

  1. Use of Language: Provide your testimony in a language you clearly understand. A court interpreter will be provided for languages other than Malay.
  2. Taking the Oath: Take the oath in the witness box in a clear and loud voice, raising your right hand to shoulder level.
  3. Identification: Present your identity card, authority card, or passport to the Interpreter for official court records.
  4. Focus and Clarity: Listen to the questions carefully and answer only what is asked. Request clarification if a question is not fully understood.
  5. Truthfulness: Ensure all testimony is honest and truthful, as witnesses are legally bound by oath to state the truth.
  6. Use of Documents: Bring any documents that need to be presented into the witness box. You must obtain the court's permission before referring to any document.
  7. Date of Continued Hearing: If your testimony is not completed, ensure you record the date of the continued hearing, as your attendance remains mandatory.
